Terms of Engagement
Last updated: May 24, 2026
These terms are a framework of trust — crafted with the same precision we bring to every creation. They define the privilege of engaging with IamTheGold.
By submitting an application, you acknowledge these terms. By signing a commission agreement, you embrace them in full.
I. Definitions
- —"We," "Us," "Our," and "The Atelier" refer to IamTheGold LLC.
- —"You" and "The Patron" refer to the individual or entity commissioning a work.
- —"The Work" or "The Bust" refers to the bespoke solid gold sculpture created from your likeness.
- —"The Digital Twin" refers to the single, eternal cryptographic certificate of authenticity bound to the physical work — a spatial, timeless proof of provenance.
- —"The Commission Agreement" refers to the individually crafted contract executed between us for the creation of your piece.
II. The Nature of Our Relationship
We are an atelier. You are a patron.
This website is an invitation to a privileged dialogue. All commissions are governed exclusively by a signed commission agreement, tailored to reflect the singularity of your piece.
III. Eligibility
You must possess full legal authority to enter into this engagement.
We do not transact with individuals or entities subject to sanctions by the United States, the United Nations, the European Union, or the United Kingdom.
We create ten works per year. An application is the first step in a mutual discovery.
IV. The Commission Process
- 1
The Application
You submit the form. We respond within forty-eight hours.
- 2
The Dialogue
A privileged exchange follows — at your convenience. You share your vision. We listen.
- 3
The Agreement
If we choose to proceed together, a bespoke commission agreement is issued, specifying scope, timeline, fee, payment schedule, delivery, and every detail that honours the significance of this creation. This agreement, once signed, is the sole governing document.
- 4
The Payment
A deposit secures your place in the year's allocation. Payment is accepted via wire transfer or, by mutual written agreement, via select digital currencies (USDC or ETH). We do not accept credit cards. We do not offer financing. Each piece is singular — every commission is a final, irrevocable act of creation.
- 5
The Essence
You share a curated selection of your most defining portraits. These are the inspiration for your bust. They are handled with the care reserved for the irreplaceable, used solely for your piece, and remain yours.
- 6
The Creation
We sculpt. We cast. We finish. You receive a final visual confirmation before your piece is delivered into the world.
- 7
The Delivery
The completed bust, its companion digital twin, and its certificate of authenticity are delivered personally to the location of your choosing. Delivery is fully insured. The moment you receive it, the legend is yours.
V. Pricing and Payment
The fee for each commission is specified in the individual commission agreement. All engagements begin at six figures (USD).
Unless otherwise agreed in writing, payment follows this schedule:
- —50% deposit upon execution of the commission agreement.
- —50% upon final visual approval, prior to delivery.
All sums are in United States dollars. The patron is responsible for any applicable duties or taxes in their jurisdiction.
VI. Intellectual Property
The Physical Bust. Upon full payment and delivery, you own the physical object outright. Display it prominently. Bequeath it. Place it in your most treasured space. It is yours to possess, to cherish, to pass on. Reproduction or commercial use requires our express written consent.
The Digital Twin. We retain copyright in the digital sculpt and preparatory materials. Upon full payment, you receive a perpetual license to possess and display the digital twin. It accompanies the physical bust, never to be separated.
The Likeness. You grant us a limited, revocable license to use your provided portraits solely for the creation of your commissioned piece. We claim no broader right to your image.
Atelier Discretion. We do not exhibit, name, or reference any commissioned piece without our patron's explicit consent. Some patrons choose to be known. Others prefer the quiet power of the unannounced. Both are honoured here.
VII. Atelier Discretion
The bond between an atelier and its patron is sacred. The details of your commission — its existence, its terms, its every contour — are held with the reverence reserved for the extraordinary. Our discretion is absolute and eternal, extending to every hand that touches your piece.
VIII. The Nature of Gold
Each bust is a handcrafted work of art. Subtle variations in gold tone, texture, and surface are not imperfections — they are the fingerprints of the fire. They are evidence that your piece was made, not manufactured. What you receive is not merely gold. It is gold that has lived.
IX. Resolution
Should any matter arise, both parties agree to resolve it through direct, good-faith dialogue — as befits a relationship of this stature.
X. Governing Law
These terms and all commission agreements are governed by the laws of the State of Hawaii, without regard to conflict of law principles.
XI. Force Majeure
Neither party shall be liable for failure to perform due to circumstances beyond reasonable control. In such event, both parties agree to negotiate an equitable resolution in good faith.
XII. Amendments
We may update these terms at any time. The version posted here is operative. Material changes will be communicated to all patrons with active commissions before taking effect.
